Dehradun, August 20, 2024 – The Uttarakhand government has announced a significant step towards accountability in response to recent riots, approving an ordinance that will enable the recovery of costs for damages incurred during civil unrest. This decision comes in the wake of violent protests that occurred in Haldwani earlier this year.
New Ordinance Details
The ordinance, titled the Uttarakhand Public (Government) and Private Property Damage Recovery (Ordinance) Law 2024, mandates that individuals found responsible for riots will be liable for compensating both public and private property damages, as well as covering medical expenses for any injuries sustained during such events.
Background of the Riots
The move follows violent protests on February 8, which erupted after the demolition of a mosque and madrasa during an anti-encroachment drive. The riots resulted in five fatalities and over 100 injuries, alongside significant property damage, including the burning of vehicles and attacks on a local police station.
Government’s Stance
Chief Minister Pushkar Dhami has stated that the law aims to deter future disturbances, asserting, “Those who disturb the peace of the state will have to pay a heavy price.”
Key Provisions of the Ordinance
- Financial Liability: Individuals involved in riots may face fines up to ₹8 lakh and will be held accountable for the full costs of damage and medical treatment for injured parties.
- Claims Tribunal: A tribunal will be established to assess damages, comprising a retired judge and an Additional District Magistrate, to oversee claims and compensation processes.
- Implementation Authority: As the state legislature is not currently in session, the ordinance will require the Governor’s approval to be enacted, utilizing powers granted under Article 213 of the Indian Constitution.

The upcoming assembly monsoon session, set to begin tomorrow, is expected to include discussions on this ordinance among other legislative matters.
