Families of victims from the 2022 Uvalde school shooting have sued Meta, Daniel Defense, and Activision, alleging Instagram allowed gun manufacturers to promote firearms to minors. The lawsuit claims Meta failed to enforce its policies banning firearm ads aimed at minors, citing Instagram posts by Daniel Defense featuring assault rifles. The Uvalde gunman reportedly opened a Daniel Defense account before turning 18 and had frequent Instagram use. Meta’s lawyers argued there is no proof minors saw these posts and that the content did not violate policies as it lacked direct purchase links. Plaintiffs countered that Meta’s algorithms likely delivered such content to the shooter and demonstrated via a recent experiment that firearm posts with purchase links were accessible to underage users. The lawsuit also targets Activision, alleging its game Call of Duty conditioned the shooter. Meta invoked the Communications Decency Act for protection, while plaintiffs argued the platform curates content and is not fully shielded.
