India Directs States To Set Up Detention Centres For Undocumented Migrants

The Union Ministry of Home Affairs has directed all Indian states and Union Territories to establish detention centres to restrict the movement of undocumented migrants until their deportation, as per the Immigration and Foreigners Order, 2025. This order, issued under the Immigration and Foreigners Act, 2025, replaces several older laws including the Passport (Entry into India) Act, 1920. Authorities are mandated to detect illegal migrants through inspections of foreigners, transport modes, and premises. Undocumented migrants found will be confined to holding centres or camps with movement restrictions until deportation steps are taken. Foreigners tribunals, currently functioning only in Assam, have been empowered to summon individuals and issue arrest warrants for non-appearance. The order also restricts foreigners’ employment in sensitive private sectors such as power, water, petroleum, defence, space technology, nuclear energy, and human rights without prior government permission. Additionally, the Bureau of Immigration will maintain a list of persons barred from leaving India if required by courts or if their exit could affect foreign relations.
