Noida News: UP Govt Restores Sector 106 Plot, Declares Eight-Year “Zero Period”

Noida: In a significant ruling likely to impact dozens of real estate disputes across the NCR, the Uttar Pradesh government has revoked a 2022 cancellation order by the Noida Authority and restored a 2,000 sq. m plot in Sector 106 to IT/ITES firm GPL Infrabuild.

The company was allotted the plot in April 2016 for a proposed software unit, but despite signing the lease deed in March 2017, it never received possession as a high-tension power line and tower blocked the site. The obstruction was cleared only in September 2025, nearly eight years later.

Officials admitted the Authority had failed to provide encumbrance-free possession, a basic obligation under the allotment terms. In its appeal, GPL Infrabuild argued it could not begin construction due to these delays and sought restoration without penalty.

After reviewing the case, Additional Chief Secretary (Industrial Development) Alok Kumar observed the Authority was at fault. On September 16, the UP Chief Secretary ruled that the period between March 30, 2017, and September 8, 2025, must be treated as a “zero period” — meaning no penalties or restoration charges would apply.

The order not only restores the plot to the company but also sets a precedent for other builders and firms caught in similar disputes where land handover was delayed due to encumbrances.
